Should You Handle Legal Separation on Your Own?

Most couples do everything they can to keep their marriage going before making the first step towards divorce. Legal separation is that first step. Legal separation means leading separate lives prior to actually divorcing. It’s a good way for each partner to take the time to figure out what they really want to do. Do they want to work though their issues or give up on their problems and call it quits. Many times legal separation helps but sometimes it serves to reinforce the need for a divorce.

There are a number of issues to take into consideration with a legal separation. You may have to deal with things such as child custody issues, who will be responsible for making the house payment, who will get which car, or who will take care of the family pets. When deciding about a legal separation, it’s always a good idea to seek the advice of a trusted attorney who has expertise in family law, legal separation and divorce. Consulting a divorce attorney is the best way to get the information you need and find out what your rights are.

You may decide to handle your legal separation yourselves, but you could be making a mistake. If you end up getting a divorce, any mistakes or oversights made during the legal separation can adversely affect your divorce and potentially have a negative impact on child custody.

No one wants to consider getting a divorce, but if you’re thinking of trying legal separation as a last ditch effort to save your marriage, don’t allow anybody to make you feel bad about your decision. You must do what you believe is the best thing for you and your family. If approached correctly, legal separation may rescue your marriage or, if nothing else, give you and your spouse more time to come to grips with the decision to end your marriage.
