Is it Necessary to Have a Divorce Lawyer?

Believe it or not some people really do have a friendly divorce. In spite of everything, if you must get a divorce an amicable one is better than a nasty one. Unfortunately, people who have friendly divorces sometimes make the mistake of not hiring individual divorce lawyers.

No matter what you may have through the many years of marriage, your divorce attorney is not something you should consider sharing with your soon to be ex-spouse. The reason for this being that a divorce lawyer is hired to protect the interests of only one party.

Sharing a divorce lawyer works out great for the lawyer because there’s no conflict about splitting the marital assets or the custody of the children or signing the divorce papers. Despite what anyone may tell you, the only things that matter in your divorce are the items which are listed in those divorce papers. Don’t be manipulated into sharing your spouse’s divorce lawyer just to save a few bucks or make the process go along faster.

The most important reason for hiring separate divorce lawyers is the protection of your interests and all the small details you haven’t thought of yet. What if your spouse wants it in writing that you can’t leave the county or go out of state with your children, even to take a vacation? Are you sure the area you live in big enough for both of you? Suppose you get a great job offer half way across the country?

By having your own divorce attorney, you will have someone to ensure your best interests are met. Now, this doesn’t mean you won’t have a friendly divorce. Quite the contrary, by not sharing your spouse’s divorce lawyer, your divorce has a better chance to be much friendlier!

Can You Handle a Do It Yourself Divorce?

If you’ve determined a do-it-yourself divorce is the best thing for your situation due to financial or other reasons, stop for a moment to make sure you’ve considered everything you should to make sure the experience goes as planned.

Keep in mind that if it’s a complex divorce, you must at least seek suitable legal counsel. In other words, if you and your spouse are unable to agree about the division of marital assets, or about child custody and child support issues, or if you have a complicated financial situation involving businesses or properties you should seek legal help. Likewise, if there’s a history of abuse in your relationship, or if spousal support is necessary then individual divorce attorneys are an absolute necessity.

If, however, your divorce is uncomplicated, reasonably friendly and there are no children involved, you may discover that a do-it-yourself divorce is a good option for your situation. You can easily find what you need for a do-it-yourself divorce by visiting the courthouse in your town or city and asking for correct forms and filing instructions.

You may find this more challenging than you expected, but it could save you lots of money because would only have to pay the filing fees and court costs. You may also be able to find the necessary forms online for a reasonable fee.

Most online services make it possible for you to complete simple forms online, then print out the official paperwork required by your state and supply you with the proper filing instructions. While completing your paperwork online may be slightly more costly, it’s a great answer for many divorcing couples. You can also decide to pay a divorce lawyer to take a look at your paperwork to make sure all is in order.
